Do you Need Permission to Embed Instagram Photos to a Blog

Is it illegal to embed Instagram photos? Do you need to get permission first? That's a good question. It's honestly unclear as to whether or not you need to get permission before embedding Instagram posts. You would think it would be just like YouTube where users had the ability to choose whether they allow embedding or not and if they do then it is free for anyone to do so. However, it seems that Instagram says it does not allow users to embed photos without getting permission first. Even though it doesn't even mention embedding in their terms of service. There have been two cases with lawsuits regarding publishers embedding Instagram posts without permission. One was successful, the other not. I don't know how you can have two identical cases with different outcomes. This whole thing is weird, and I'd probably just avoid it if I was you. But you do have a leg to stand on because of the "server test". When you embed something it is not hosted on your server therefor you are not liable. It's up to you what you do, and I'm curious what you think about all this and if you have ever run into this problem before.
